New Fee for the Transmission of Passenger Data Introduced by Law No. 38/2025
The Albanian Government, through Law No. 38/2025, has introduced a new fee of 200 ALL per passenger for all land, air, and sea transport operators that transmit passenger information to the Travel Intelligence Sector systems. The fee will be applied for an initial period of one year, after which it will be reviewed every three years based on the real operational costs of the service.
The purpose of this fee is to cover the technological and operational expenses required for collecting, transmitting, transforming, and securing passenger travel data. Revenue generated will support the infrastructure used for these services, including servers, system maintenance, software licenses, and ongoing technical support.
Transport operators must follow a monthly reporting and payment procedure. Each month, operators submit the total number of passengers transported. The Travel Intelligence Sector then verifies the data, after which the responsible economic operator issues a monthly invoice. All payments must be completed within 30 days. Any late payment will be subject to the legal provisions governing late commercial payments.
Certain categories are exempt from this fee, including children under 2 years old without a reserved seat, humanitarian travel verified by the appropriate state authorities, and state transport missions carried out for special security or emergency purposes.
The law also specifies situations where sanctions will not apply. These include unexpected technical failures, incidents of force majeure, or cases where the operator promptly notifies the issue and resolves it within a reasonable period. This ensures a balanced approach that promotes compliance while recognizing unavoidable operational challenges.
