Electronic Registration of Lease Contracts on e-Albania




 

 

 

In Albania, a rental relationship does not end with the mere signing of a contract between the parties. In certain cases, the law requires that the lease agreement be electronically registered through the e-Albania platform, making it an official and legally enforceable document against third parties.


Legal Basis

The obligation to register lease agreements is based primarily on the following laws:

  • Law No. 111/2018, dated 20.12.2018 “On Cadastre”, which requires the registration of lease and sublease contracts lasting more than nine years and concluded by notarial act.

  • The Civil Code of the Republic of Albania, which establishes that a registered lease contract has legal effect against third parties and provides stronger protection for both the landlord and the tenant.

  • Law No. 9920/2008 “On Tax Procedures”, which obliges landlords to declare rental income and sets penalties for non-compliance.


How to Register a Lease Contract on e-Albania

  1. Access e-Albania with your personal account.

  2. Search for the service “Application for registration of lease/sublease contract.”

  3. Fill in the required data and upload the necessary documents (notarized contract, property titles, and identification documents of both parties).

  4. The application is reviewed by the State Cadastre Agency (ASHK). The result and registration confirmation are sent online in the “My Documents” section and via email.


What Happens If You Don’t Register

  • Lack of Legal Protection – an unregistered contract has limited legal value against third parties and may not be recognized in the event of a dispute.

  • Tax Issues – undeclared rental income can lead to fines under the Law on Tax Procedures.

  • Absence from Official Records – this can create complications when selling the property, leasing it again, or resolving legal disputes.
